1. General provisions

1.1. These Terms and Conditions govern your use of the Automotivate Leasing Limited website and your interactions with Automotivate Leasing Limited.

1.2. By using our website or services, you confirm that you are at least 18 years old and capable of entering into legally binding agreements.

1.3. We may update these Terms and Conditions from time to time. The version published on this page applies to your use of the website at that time.

2. Our role

2.1. Automotivate Leasing Limited is an independent credit broker, not a lender. We may introduce business customers to funders through Fleet Alliance Limited. We do not provide independent financial advice.

2.2. Automotivate Leasing Limited is an Appointed Representative of Fleet Alliance Limited. Fleet Alliance Limited is authorised and regulated by the Financial Conduct Authority, reference 673150. Not all types of business undertaken are authorised and regulated by the Financial Conduct Authority.

2.3. We do not search every lender or finance product in the market. Any introduction will be made from the funding arrangements available through Fleet Alliance Limited.

3. Website information and quotations

3.1. Vehicle descriptions, availability, specifications, rentals and other information on this website are provided for general information and may change without notice.

3.2. We take reasonable care to keep website information accurate but cannot guarantee that it is complete, current or free from typographical errors.

3.3. A quotation request is not a finance application, does not guarantee vehicle availability or pricing, and does not create a binding agreement.

3.4. Quotations are subject to availability, status, credit approval and funder terms. Unless expressly stated otherwise, business leasing rentals exclude VAT.

4. Finance applications and agreements

4.1. If you choose to proceed, you may be asked to complete a separate finance application and provide information required by the proposed funder.

4.2. A funder may carry out business and personal credit checks after providing the required notices. Approval is at the funder’s discretion.

4.3. The vehicle, term, mileage, initial rental, maintenance basis, payments, fees and end-of-contract responsibilities will be set out in the quotation, pre-contract information and finance agreement.

4.4. Where these website terms differ from a signed finance agreement or funder document, the relevant signed agreement or funder document will take precedence for that finance arrangement.

5. Pricing, fees and commission

5.1. Review the complete payment profile and all applicable fees before entering into an agreement. Excess-mileage, early-termination and vehicle-condition charges may apply.

5.2. Automotivate Leasing Limited and Fleet Alliance Limited may receive commission for introducing your business to a funder. Commission arrangements can vary by funder, product and agreement.

5.3. You may ask for information about the commission applying to a proposed agreement before entering into it. See our Commission Disclosure.

6. Delivery and vehicle inspection

6.1. Delivery dates are estimates until confirmed. They may be affected by manufacturer, supplier, funder, conversion, transport or other circumstances outside our reasonable control.

6.2. You are responsible for checking the vehicle on delivery and reporting any visible damage, missing equipment or specification discrepancy promptly in accordance with the delivery documentation.

7. Cancellations and early termination

7.1. Tell us as soon as possible if you wish to cancel before entering into a finance agreement. A supplier, converter or funder may impose a cancellation or administration charge where costs have already been incurred and this has been disclosed or agreed.

7.2. After a finance agreement has been entered into, cancellation, withdrawal and early-termination rights are governed by that agreement, applicable funder terms and applicable law.

7.3. Business agreements may not carry the same cancellation rights as consumer agreements. You should review the documentation carefully before signing.

8. Warranties, maintenance and use

8.1. A vehicle may be supplied with a manufacturer warranty. The scope and duration are governed by the manufacturer’s terms.

8.2. You are responsible for operating, servicing, maintaining and insuring the vehicle in accordance with the finance agreement, manufacturer requirements and applicable law, except where a maintenance package expressly covers an item.

9. Limitation of liability

9.1. Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

9.2. To the fullest extent permitted by law, we are not liable for indirect or consequential business loss arising from use of this website or reliance on general website information.

9.3. Nothing on this website replaces the specific quotation, pre-contract information, finance agreement, manufacturer warranty or funder documentation supplied in relation to a transaction.

10. Privacy

Your personal information will be handled in accordance with the Automotivate Privacy Policy. Our separate Leasing Legitimate Interests Assessment explains relevant business-to-business processing.

11. Governing law

These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from or connected with these terms is subject to the jurisdiction of the courts of England and Wales.
